1. Website operator

These Terms & Conditions govern access to the informational website at diamond-protocol.com (the “Website”), operated under the brand Diamond Protocol (“we”, “us” or “our”).

For enquiries about this Website, contact diamondp@diamond-protocol.com.

2. Scope and acceptance

By browsing this Website, you agree to use it lawfully and in accordance with these terms. If you do not agree, you should discontinue use. The Website is intended primarily to describe our software development, web application, automation and integration services.

These terms govern the Website itself. They do not, on their own, establish the terms for purchasing, licensing, hosting or using a particular application or custom software service. Those matters require the relevant product terms, proposal, statement of work or separate agreement.

3. Information and availability

We seek to keep the content accurate and current, but descriptions, examples, design concepts and other Website material are provided for general information. Features, service availability, timelines and deliverables depend on each engagement and are not guaranteed solely by being displayed here.

We may update, suspend or discontinue parts of the Website when reasonably necessary. Any express warranties or service levels must be agreed separately in writing.

4. Intellectual property

Unless otherwise stated, the Website's branding, layout, original copy, designs and related content are owned by us or used with permission. You may view and share links to the Website, but may not reproduce or commercially exploit substantial parts of it without the relevant permission, except where applicable law permits.

Ownership and licensing of software developed for clients are determined by the applicable signed agreement, not by these Website terms.

5. Acceptable use

You must not attempt unauthorised access, interfere with the Website, upload malicious code, engage in abusive automated traffic or violate applicable laws. Please do not send credentials, financial account details, confidential datasets or sensitive personal information in an initial project email.

6. Client and end-user data

Our business approach is to avoid routine access to, independent use of, or monetisation of personal data belonging to end users of applications used by our clients. We do not claim blanket technical inability to access such information across every possible architecture.

Depending on a specific solution, our role may be limited to software development, or authorised technical access may be needed for deployment, maintenance, troubleshooting or hosting. Any such access must be governed by appropriate instructions, permissions and contractual arrangements.

Where Diamond Protocol processes personal data on behalf of a client acting as controller, a separate data processing agreement meeting the requirements of applicable law, including Article 28 GDPR where relevant, should be concluded before the processing begins. The client remains responsible for its own end-user notices, lawful grounds for processing and permissions as applicable.

We do not sell or independently use client end-user data for advertising or profiling as part of the website services described here.

7. External services and links

Solutions may connect to third-party software, APIs, payment providers, communications platforms or infrastructure. Those third parties have their own terms, security measures and privacy policies. We are not responsible for third-party services except to the extent expressly agreed or required by applicable law.

8. Liability

To the extent permitted by applicable law, we do not guarantee that the Website will be uninterrupted, error-free or suitable for every particular purpose. We are not liable for losses arising solely from reliance on general informational Website content, except to the extent liability cannot lawfully be excluded.

Nothing in these terms limits statutory rights or liability that cannot be excluded under applicable consumer protection, data protection or other mandatory laws. Contractual liability relating to software projects is governed by the relevant separate agreement and mandatory law.

9. Governing law and disputes

These Website terms are governed by the laws of the Republic of Slovenia, subject to any mandatory protections that applicable law grants to users or consumers in other jurisdictions. Any dispute resolution arrangements required by mandatory law prevail over conflicting provisions here.

10. Updates and contact

We may amend these Website terms by posting an updated version and changing the effective date. Material changes affecting an existing signed contract require the approach specified in that contract.
